UK Immigration Rules – New Statement of Changes – September 2023

The UK Home Office released a statement of changes to the UK Immigration rules on 7 September 2023.

Clients must stay informed about changes to the UK Immigration rules and regulations. Changes can significantly impact visa eligibility, application processes, and requirements. By being aware of changes, clients can ensure they prepare are compliant and avoid legal complications or delays in their immigration journey. Removal of Administrative Review

From 5 October 2023, applicants will no longer have a right of an administrative review for all decisions relating to the EUSS matters, the EUSS Family permit and the S2 Healthcare Visitor Visa. Applicants will, however, still have a right of appeal.

Public Funds under the UK Immigration Rules

Most migrants with limited leave to remain have “No recourse to public funds’ attached to their visa terms. The Home Office has expanded this list to include the new Social Security Scotland benefits and to clarify existing DWP and DLUHC benefits.

Youth Mobility Scheme

Applicants from Australia and Canada will be delighted to hear that the age range and length of stay have been expanded for citizens from these two countries. The new age range will be 18 – 35 years, up from 18 – 30 years. The length of stay is three years, up from two years. 

Andorra will be added to the list of eligible countries able to apply for the Youth Mobility Scheme.

The Youth Mobility Scheme changes will occur from 31 January 2024.

Prison Service Officers added to Skilled Worker Route

Prison Service Officers will be eligible to apply for the Skilled Worker route. The occupation will meet the skills threshold. Workers can be sponsored if the Civil Service nationality requirements are met.
