Applying for a UK Visa or Permit with a Previous Immigration Breach
The Home Office will not necessarily refuse a UK Visa application from a person with a prior immigration breach or other problems. Immigration breaches might include deportation, refusal of entry at the UK border, illegal entry into the UK, overstaying on your UK visa, criminal offences or the breach of immigration rules of another country.
There are certain circumstances under which the UK may refuse your application on such grounds. Breytenbachs can advise on the likelihood of the impact of these immigration breaches on your UK Visa application. We can never guarantee that such an application will be successful. It is, however, of the utmost importance that you declare a previous immigration breach when you apply for any UK visa or permit.

According to the Immigration Rules, Part 9, an application for entry clearance, permission to enter, or stay may be refused where false representations are made, or false documents or information are submitted.
The Home Office and UKVI have a system of checks and balances. You will eventually be found out for lying about any facts or breaches. It is thus very important that you disclose all relevant facts.
Therefore, per the Immigration Rules and in our experience, if you don’t disclose certain information and don’t answer the questions on your online UK visa application truthfully, the UK Visas and Immigration will view you as trying to mislead and deceive the British government. They will refuse your application and can ban you from the UK for ten years or longer.
